Gameday Pools LLC, doing business as Gameday Pools, and as applicable, its subsidiaries and affiliates (collectively, "Gameday Pools," "we," "our," or "us") operates www.gamedaypools.com and related services that support sports prediction contests, Organization Challenges, leaderboards, prize administration, community engagement programs, and related features (collectively, the "Services"). This Privacy Policy explains how we collect, use, disclose, and protect information when you access or use the Services.
This Privacy Policy applies where it is linked or referenced. It should be read together with our Terms of Service and any challenge-specific, organization-specific, or prize-specific rules that apply to your participation.
1 INFORMATION WE COLLECT
1.1 Account and Identity Information. We may collect information you provide when creating or updating an account, joining a competition, accepting an invitation, verifying eligibility, or contacting us. This may include your name, display name, email address, password or authentication information, phone number, account status, and communication preferences.
1.2 Organization Affiliation Information. If you participate in an Organization Challenge, we may collect organization-related information needed to administer the challenge. This may include your apartment unit, floor, building, residence designation, department, office location, employer, club, homeowner association, alumni association, membership status, invitation status, email domain, organization affiliation, or similar information connected to a participating organization.
1.3 Competition and Participation Information. We collect information related to your use of competitions and challenges, including registration date, participation status, picks, entries, scores, rankings, leaderboard position, winner status, prize eligibility, prize fulfillment status, and engagement activity such as whether you opened or responded to challenge-related communications.
1.4 Profile Photos and Profile Information. If you upload a profile photo or other profile details, we collect and store that information so it can be displayed in connection with your account, competitions, leaderboards, winner announcements, and other Services. We may also collect review, moderation, or approval information related to profile photos.
1.5 Communications and Support Information. We collect information when you contact us, respond to emails, submit forms, request support, participate in surveys, or otherwise communicate with Gameday Pools. This may include message contents, support history, and related metadata.
1.6 Payment and Billing Information. If you purchase an organization subscription, upgrade, or paid service, payment information may be processed by third-party payment providers such as Stripe. We may receive transaction status, customer identifiers, plan information, invoices, subscription status, billing contact information, and related records. We do not store full payment card numbers.
1.7 Device, Usage, and Technical Information. We may automatically collect information about the devices and browsers used to access the Services, including IP address, device type, browser type, operating system, pages viewed, links clicked, date and time of access, referring pages, application usage, error logs, security logs, approximate location derived from IP address, and similar analytics or diagnostic information.
1.8 Information From Organizations and Other Sources. Sponsoring organizations, organization administrators, property managers, club administrators, employers, associations, invite systems, payment providers, service providers, or other participants may provide information about you, such as eligibility, organization affiliation, invitation status, prize fulfillment details, or corrections to registration information.
2 HOW WE USE INFORMATION
2.1 We use information to provide, operate, maintain, secure, and improve the Services, including to:
• Create and manage accounts;
• Administer competitions and Organization Challenges;
• Verify eligibility and organization membership;
• Process entries, picks, scores, rankings, and leaderboard results;
• Generate leaderboards and other competition displays;
• Award, verify, fulfill, or help administer prizes;
• Communicate with participants about accounts, competitions, reminders, standings, deadlines, prizes, announcements, and service updates;
• Display profile photos, display names, organization details, winner announcements, and competition results where appropriate;
• Provide organization administrators with tools to manage their competitions;
• Respond to support requests, questions, and complaints;
• Prevent fraud, cheating, abuse, unauthorized access, and violations of our Terms;
• Analyze usage, measure engagement, troubleshoot issues, test features, and improve the Services;
• Maintain business, tax, accounting, billing, security, and legal records; and
• Comply with applicable laws and protect our rights, users, organizations, and Services.
2.2 Email Communications. We use your email address to send operational communications related to your account and participation, including verification messages, invitations, registration confirmations, picks reminders, competition deadlines, weekly updates, standings, prize notices, winner announcements, organization announcements, and important service or policy notices.
2.3 Aggregate and De-Identified Information. We may create aggregate, anonymized, or de-identified information from personal information and use it for analytics, reporting, product improvement, marketing, or other lawful business purposes.
3 ORGANIZATION CHALLENGES AND INTERNAL VISIBILITY
3.1 Organization Challenges are competitions or community engagement experiences sponsored, administered, promoted, or facilitated by a participating organization, such as an apartment community, employer, club, homeowner association, alumni association, venue, brand, or other group.
3.2 Internal Leaderboard Sharing. If you participate in an Organization Challenge, certain profile and competition information may be visible to other authorized participants in that Organization Challenge. This may include your display name, first name, last initial, profile photo, apartment unit, floor, building, department, office location, residence designation, organization affiliation, picks, scores, rankings, leaderboard position, prize status, winner status, and other challenge-related information.
3.3 Organization Administrators. Organization administrators, property managers, club administrators, employer administrators, association representatives, and other authorized sponsor representatives may access information needed to administer their Organization Challenge, verify eligibility, communicate with participants, review participation, measure engagement, and support prize administration.
3.4 Resident Rosters and Community Information. When a sponsoring organization provides a resident, member, employee, or other community roster, we use that information only to set up, administer, secure, and report on the applicable Organization Challenge. This may include eligibility and resident verification, account or invitation administration, operational communications, participation reporting, and support. We do not sell or rent identifiable resident or community member roster information, including names, email addresses, unit numbers, floors, or similar information. We also do not sell or rent non-public community or building information provided to us, including building details, resident counts, communication channels, branding assets, and kickoff information.
3.5 Sponsor Content and Aggregate Reporting. We may display sponsor, partner, organization, or promotional content within the Services. We may also create, use, and disclose aggregated or de-identified information, such as program-level participation totals, engagement trends, and community analytics. We do not provide a sponsoring organization’s resident roster or other identifiable resident or community member information to sponsors or partners for their own marketing purposes, unless the applicable organization or individual separately authorizes that disclosure or we clearly describe it at or before collection.
4 HOW WE DISCLOSE INFORMATION
4.1 Organization Sponsors. If you participate in an Organization Challenge, we may share certain information with the sponsoring organization to administer, measure, promote, and support the competition. This may include name, email address, registration date, participation status, eligibility or verification status, organization affiliation, unit, floor, building, department, office location, picks or submission activity, leaderboard position, winner status, prize eligibility, prize fulfillment information, and engagement metrics.
4.2 Other Participants. As described above, your profile information and competition-related information may be visible to other authorized participants within the applicable Organization Challenge or competition.
4.3 Service Providers. We may share information with vendors and service providers who help us operate the Services, including hosting providers, database providers, email delivery providers, analytics providers, payment processors, security tools, image storage or processing providers, customer support tools, and professional advisors. These providers may access information only as needed to perform services for us, subject to their own obligations and applicable law.
4.4 Payment Providers. Payment and subscription-related information may be shared with payment processors, banks, card networks, and billing service providers as needed to process transactions, manage subscriptions, prevent fraud, and comply with payment rules.
4.5 Legal, Safety, and Enforcement. We may disclose information if we believe disclosure is necessary or appropriate to comply with law, legal process, law enforcement requests, government inquiries, enforce our Terms, investigate fraud or cheating, protect the rights, safety, and security of Gameday Pools, users, organizations, or the public, or defend against legal claims.
4.6 Business Transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction.
4.7 With Consent or Direction. We may disclose information for any other purpose disclosed to you at the time of collection or with your consent or direction.
5 PROFILE PHOTOS, WINNER ANNOUNCEMENTS, AND PUBLICITY
5.1 Profile photos may be displayed in connection with your profile, competition entries, leaderboards, standings, winner announcements, organization pages, and other participant-facing portions of the Services.
5.2 We may review, reject, remove, resize, crop, moderate, or restrict profile photos that violate our Terms, appear inappropriate, infringe rights, create safety concerns, or are not suitable for the Services.
5.3 If you win or qualify for a prize, we may display or share limited winner information, such as your first name, last initial, profile photo, organization affiliation, competition results, winner status, and prize eligibility, for winner announcements and competition administration, unless prohibited by law.
6 COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES
6.1 We may use cookies, local storage, pixels, log files, and similar technologies to operate the Services, keep you signed in, remember preferences, measure usage, protect against fraud and abuse, troubleshoot issues, and improve performance.
6.2 We may use analytics providers, such as Google Analytics or similar services, to understand how users access and use the Services. These tools may collect information such as pages visited, browser type, device type, approximate location, referring pages, and usage patterns.
6.3 You may be able to adjust cookie settings through your browser. Some features of the Services may not function properly if cookies or similar technologies are disabled.
7 DATA RETENTION
7.1 We retain information for as long as reasonably necessary to provide the Services, administer competitions, maintain records, comply with legal obligations, resolve disputes, prevent fraud or abuse, enforce our Terms, support tax or accounting requirements, and operate our business.
7.2 Competition records, leaderboard results, prize records, eligibility records, and organization participation records may be retained after a competition ends where needed for audit, dispute resolution, sponsor reporting, fraud prevention, tax, legal, or administrative purposes.
8 SECURITY
8.1 We use reasonable administrative, technical, and organizational safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction. However, no internet or electronic storage system is completely secure, and we cannot guarantee absolute security.
8.2 You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your devices.
9 YOUR CHOICES AND RIGHTS
9.1 You may request access to, correction of, or deletion of certain personal information by contacting us at support [at] gamedaypools [dot] com. We may need to verify your identity before responding.
9.2 We may deny or limit a request where permitted by law, including where information must be retained for legal, security, fraud prevention, competition integrity, prize administration, accounting, dispute resolution, or business record purposes.
9.3 Depending on where you live, you may have additional privacy rights under applicable state, federal, or international privacy laws, including rights to know, access, correct, delete, receive a portable copy of, or opt out of certain uses or disclosures of personal information.
9.4 Operational Communications. Some communications are necessary to provide the Services, administer competitions, verify eligibility, send reminders, provide standings, distribute prize notices, or deliver important account and policy notices. You may not be able to opt out of operational communications while maintaining an active account or active competition participation, except where required by law.
10 CHILDREN AND AGE REQUIREMENTS
10.1 The Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take appropriate steps to delete it.
10.2 Participation in competitions may be limited to users who are at least 18 years old or the age of majority in their jurisdiction, unless participation is expressly permitted by the sponsoring organization and applicable law.
11 INTERNATIONAL USERS
11.1 Gameday Pools is based in the United States. If you access the Services from outside the United States, you understand that your information may be collected, processed, stored, and transferred in the United States and other jurisdictions where privacy laws may differ from those in your jurisdiction.
12 THIRD-PARTY LINKS AND SERVICES
12.1 The Services may link to or integrate with third-party websites, services, payment tools, organization materials, sponsor content, or other resources that we do not control. This Privacy Policy does not apply to third-party services, and we are not responsible for their privacy, security, or content practices.
13 CHANGES TO THIS PRIVACY POLICY
13.1 We may update this Privacy Policy from time to time. When we do, we will revise the updated date above. Your continued use of the Services after an updated Privacy Policy is posted means you acknowledge the updated policy.
